1. Who we are
Topica Mag (“Topica,” “we,” “us,” “our”) publishes editorial content on art, film reviews, books, and typefaces at topicamag.com (the “Service”). We operate the Service from Argentina and make it globally accessible without targeting any specific country or region. These Terms & Conditions (the “Terms”) govern your access to and use of the Service worldwide.
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
General audience. If you are a minor, use only with consent of a parent or guardian and as allowed by local law.
3. Changes to these Terms
We may update these Terms at any time. The “Last updated” date shows the effective date. Using the Service after an update means you accept the revised Terms.
4. Editorial nature of the Service
Topica is an editorial platform. We do not sell products, run job postings, or operate an affiliate program. Our content covers art, film reviews, books, and typefaces.
5. Intellectual property
5.1 Our content. All content on the Service (text, images, graphics, video, audio, code, design) is owned by us or our licensors and protected by applicable laws worldwide. Except as allowed by mandatory law, you may not copy, reproduce, adapt, distribute, mirror, frame, scrape, or create derivative works without prior written permission.
5.2 Third-party materials. Trademarks, film stills, book covers, type specimens, and other third-party materials remain the property of their owners. Nothing in these Terms grants you rights in third-party materials.
5.3 Limited license. We grant you a revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in line with these Terms.
5.4 No data mining / AI training. You may not use the Service or any content to develop, train, or improve AI/ML models or datasets, nor to run text-and-data mining, without our prior written permission.
6. User submissions (currently disabled)
We do not currently offer accounts, comments, or uploads. If enabled later, we will post updated terms governing submissions, moderation, and licenses.
7. Copyright complaints (global)
We respect intellectual property. If you believe material on the Service infringes your rights, email hello@topicamag.com with: (i) your name and contact details; (ii) identification of the work claimed infringed; (iii) the exact URL of the allegedly infringing material; (iv) a good-faith statement that the use is not authorized; and (v) a statement that the information is accurate and that you are the rights holder or authorized agent. We may remove or restrict content and, where applicable, notify the poster. Repeat infringers may be restricted.
8. Prohibited uses
You agree not to:
a) reverse engineer or attempt to derive source code;
b) bypass access controls, rate limits, or security;
c) use bots, scrapers, or automated means to access or copy the Service without written permission;
d) mine, harvest, or compile the content or metadata, including for AI/ML or dataset creation;
e) interfere with operation or place unreasonable load on our infrastructure;
f) use the Service for unlawful purposes, including infringement, defamation, privacy violations, or harassment.
9. Editorial independence and disclosures
Coverage reflects editorial judgment. We do not accept compensation for positive coverage. If we receive review copies, access, or other consideration, we may disclose that context. We do not run paid affiliate links or sponsored posts at this time. If that changes, we will update these Terms and disclose sponsorships clearly.

Our processing of personal data is described in our Privacy Policy at topicamag.com/privacy. By using the Service, you acknowledge the Privacy Policy.
12. International use and compliance
You are responsible for complying with the laws that apply where you access the Service. Access is not permitted where it would violate applicable sanctions, export controls, or other laws. We do not market or direct the Service to any specific jurisdiction, including the EEA or the UK. The Service is operated from Argentina and provided on a geo-neutral basis.
13. No warranties
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the Service will be uninterrupted, secure, error-free, or that content is complete or current.
14. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities, arising from or related to your use of the Service. Where applicable law does not allow exclusion of certain damages, those exclusions apply only to the extent permitted. Our aggregate liability for all claims relating to the Service is limited to USD 100.

You agree to defend, indemnify, and hold harmless Topica and its directors, officers, employees, and contractors from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service or your breach of these Terms.
16. Governing law, venue, and cross-border enforcement
a) Governing law. These Terms are governed by the laws of the Ciudad Autónoma de Buenos Aires, Argentina, without regard to conflict-of-laws rules.
b) Venue. Courts located in CABA, Argentina have exclusive jurisdiction over disputes, subject to applicable consumer-protection rules.
c) Injunctive relief worldwide. We may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information, without submitting to general jurisdiction elsewhere.
d) Class actions. To the extent permitted by applicable law, disputes will be conducted on an individual basis and not as a class or representative action.
e) Language. The controlling language of these Terms is English. Translations are for convenience only.
17. Severability; entire agreement; no waiver
If any provision is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and us regarding the Service. Our failure to enforce a provision is not a waiver.
